DUI — known in some other states as driving while intoxicated (DWI) — is a criminal charge that can result in jail time, license suspension and other serious consequences.

Tennessee has an implied consent law, which means that if you obtain a driver’s license and drive on public roads within the state, you have consented in advance to taking a blood or breath test for alcohol or drugs if the police stop you and ask you to take one.

If you refuse the test, you will automatically and immediately lose your driver’s license for a year. If you test over the limit, you will be charged with DUI, but you will not lose your license right away.

If you are stopped on suspicion of drunk driving and asked to take a test, from our experience, it is usually best that you take the test.
